A sublease agreement is a rental agreement between two parties regarding a shared rental unit. One party is included in the primary lease agreement with the landlord, while the second party is not. If a landlord prohibits sublets in the property, they have to give written consent to a tenant in order for that tenant to sublease to a third party. Within a sublease arrangement, the landlord’s responsibilities shift to the primary tenant who signs the sublease. So that tenant is responsible for any and all actions against the subtenant on behalf of the actual landlord. Also, it’s recommended that primary tenants run background checks on subtenant applicants. Primary tenants can require rental applications to gather the information necessary to conduct background checks.
