A sublease agreement authorizes a relationship between two parties regarding a shared rental unit. One party is included in the primary lease agreement with the landlord, while the second party is not. If the primary lease agreement doesn’t allow subleases, the primary tenant has to get the landlord’s consent to enter into a sublease agreement with a third party. The primary tenant acts as the landlord to the subtenant and is therefore responsible to the landlord for all of the subtenant’s actions. A primary tenant can utilize rental applications to collect the information they need to conduct background checks on all sublessee applicants.
