A sublease agreement is a rental agreement between two parties regarding a shared rental unit. One party is included in the primary lease agreement with the landlord, while the second party is not. If the primary agreement doesn’t allow subletting, the primary tenant will need to obtain consent from the landlord for a sublease agreement to be valid. In a sublease, the primary tenant is liable for all actions of the subtenant in the eyes of the landlord. The primary tenant is responsible for any and all legal actions that may need to be taken against the subtenant.
