An Arkansas sublease agreement enables a tenant to rent a property that he or she is currently leasing to another tenant, called a “subtenant.” In a sublease, the tenant must ensure that the subtenant follows the provisions of the original lease agreement, and is liable for rent if the subtenant fails to pay. Most lease agreements prohibiting subletting, because the original lease agreement was personal to the tenant, not the subtenant. However, if a tenant is at risk of being unable to make rent, and a sublease will prevent the landlord from missing a month or more of rent payments, the landlord may allow it.
