A sublease agreement is a contract between two parties, one of which is a primary tenant in a rental property. The second party is not listed as a tenant on the primary lease agreement. Any sublease agreement that does not have the landlord’s blessing is considered invalid. If a subtenant violates either lease agreement, the primary tenant is directly responsible to the landlord. They essentially function as the subtenant’s landlord. The primary tenant needs to require potential sublessees to complete a rental application before signing a sublease agreement.
