A sublease agreement allows for a relationship between two parties, one of which is a primary tenant in a rental property. The second party is not listed as a tenant on the primary lease agreement. If a landlord prohibits subletting in their rental property, any tenant that wants to sublease to a third party has to first obtain that landlord’s express permission. When a primary tenant enters into a sublease relationship, they assume all roles and responsibilities of the landlord in the eyes of the subtenant. A primary tenant can use rental applications to gather the information needed to conduct background checks on all sublet applicants.
