A sublease agreement is a contract between two parties regarding a shared rental unit. One party is included in the primary lease agreement with the landlord, while the second party is not. When the primary lease agreement prohibits subletting, that tenant has to get the landlord’s permission to sublease to a third-party tenant. The primary tenant is essentially the landlord to the subtenant, so they assume all landlord responsibilities when it comes to the sublease. Also, it’s recommended that primary tenants run background checks on potential sublessees. Rental applications can gather the information necessary to conduct background checks.
