A New Mexico sublease agreement establishes a formal rental relationship between two tenants, one who is the primary tenant of a rental unit. The subtenant rents directly from the primary tenant, not the landlord. This arrangement can only be made with the consent of the landlord on the original lease agreement with the primary tenant. Under a sublease, the subtenant is liable to the primary tenant. The primary tenant has to manage any disciplinary actions against the subtenant in the instance the subtenant violates the sublease agreement. It’s recommended that all possible subtenants apply with a formal rental application.
