A North Carolina sublease agreement is a rental contract outlining the relationship between two or more parties, at least one of which is a secondary tenant in a rental unit. The primary tenant or tenants, who have a separate lease agreement with the landlord, act as the landlord to the secondary tenant. This tenancy is only valid with the primary landlord’s consent. With a sublease, the secondary tenant is liable to the primary tenant, not the landlord of the property. The primary tenant is responsible for the secondary tenant’s actions under their own lease agreement with the landlord. Therefore, they are responsible for all disciplinary actions against the secondary tenant. It’s wise to run background checks on all secondary tenant applicants. Rental applications can collect all of the information necessary to run full background checks on individuals.
