A Colorado month-to-month rental agreement is a lease agreement that allows a tenant to occupy a property for one month and renews with each rent payment. Either the tenant or the landlord is permitted to terminate the agreement at any time, which marks a departure from a standard lease agreement that contracts both parties to a longer-term period. The month-to-month agreement allows for greater flexibility, but provides lesser security.
Minimum Termination Period
If a tenant has been living at the premises for one (1) year or longer, ninety-one (91) days’ notice must be given before the agreement may be terminated. A tenancy of six (6) months or longer requires twenty-eight (28) days’ notice; a tenancy of one (1) month requires twenty-one (21) days; a tenancy of one (1) week requires three (3) days; and a tenancy of less than one (1) week requires one (1) day’s notice.
