A sublease agreement is a rental contract between two parties, one of which is a primary tenant in a rental property. The second party is not listed as a tenant on the primary lease agreement. A landlord must always consent to a sublease agreement, whether the primary lease agreement permits it or the sublease agreement requires the landlord’s endorsement. Landlords are not responsible for subtenancies in their rental properties in the same way they are for primary tenancies. In a sublease situation, the primary tenant acts as the landlord to the subtenant in place of the actual landlord. A primary tenant can require potential subletters to complete a rental application. This form will include the information necessary to run background checks on applicants.
