A sublease agreement is a rental agreement between a primary tenant in a rental unit and a subtenant that is not on the primary lease for said unit. If the primary lease agreement doesn’t allow or doesn’t mention sublets, the landlord must consent to any sublease agreements in their property. In a sublease relationship, all liability of the subtenant and their actions falls to the primary tenant of the rental unit. The primary tenant has to handle any issues that arise with the subtenant violating either the sublease or primary lease agreements. The primary tenant should require potential subtenants to fill out a rental application before drawing up a sublease agreement.
