A New York sublease agreement is a contract outlining the relationship between two tenants of a rental unit, one primary and one secondary. The primary tenant has a lease agreement with the landlord, but the secondary tenant is not included in that agreement. Sublets are possible when a landlord gives their primary tenant permission to enter into a sublease agreement with the secondary tenant. By signing a sublease agreement, the primary tenant assumes the role and responsibilities of the landlord in the eyes of the law. Secondary tenant applicants should submit rental applications to the primary tenant for the purpose of running background checks.
