An Illinois sublease agreement enables the tenant of a property to rent the property to a third party, called a subtenant. This is called subleasing or subletting, and lease agreements often restrict the practice. However, a landlord may be willing to agree to a sublease in certain circumstances, such as when a tenant is facing temporary financial difficulties and is at risk of missing rent. Traditionally, a tenant remains liable for rent if the subtenant fails to pay.
Landlord’s Consent Form – The original lease agreement may require a landlord’s permission to engage in a sublease.
