A New Mexico standard residential lease agreement contractually binds a landlord and tenant upon executing a deal for a rental arrangement, whereby the tenant pays the landlord a monthly lump sum in exchange for a liveable occupancy. A tenant will require the landlord’s approval prior to entering any such leasing contract. To identify which individual should become their tenant, landlords often request prospects to fill out a rental application and consent to criminal and credit checks. Tenants with subpar credit, who are still otherwise qualified, may seek a guarantor (co-signer) to entice the landlord. Still, a landlord reserves the right to deny a tenancy under state and federal law.
