A New Mexico month-to-month rental agreement, also referred to as a “tenancy-at-will”, is a binding short-term rental agreement between a tenant and a landlord. This tenancy has no official end date and either party is permitted to terminate or amend the agreement with at least thirty (30) days’ notice. Amendments and terminations must follow whatever rules are outlined in the lease agreement and recognize the minimum termination laws in New Mexico. It’s suggested that the landlord utilizes a rental application to verify the tenant’s income and background before executing a rental agreement.
Minimum Termination
Landlords and tenants have to provide the other party with at least thirty (30) days’ notice before terminating a month-to-month tenancy.
