Illinois Month-to-Month Rental Agreement

An Illinois month-to-month rental agreement enables landlords and tenants to create an otherwise standard lease without a set ending date. Also called a “tenancies at will,” month-to-month rental agreements can end as soon as either party desires, so long as the terminating party complies with notice requirements. Landlords may find the flexibility of a month-to-month agreement desirable if they are thinking about developing a property, while tenants may seek the arrangement if they are considering moving out of the area.

Minimum Termination Period

The landlord may terminate the tenancy by 30 days’ notice, in writing. There is no statutory provision for the required notice tenants must give to terminate, but 30 days’ written notice is recommended.
