Idaho Month-to-Month Rental Agreement

An Idaho month-to-month rental agreement creates a lease with no set duration. Either the landlord or the tenant may end the lease, regardless of how much time has passed, so long as the terms of the agreement and the state notice provisions are met. Month-to-month rental agreements, also known as tenancies at will, resemble standard leases, but provide flexibility that some landlords and tenants want.

Minimum Termination Period

A tenancy at will, however created, may be terminated by the landlord’s giving notice in writing to the tenant, in the manner prescribed by the code of civil procedure, to remove from the premises within a period of not less than one (1) month, or by the tenant giving notice in writing to the landlord that the tenant will be vacating the premises, on a date as specified in the notice, but not less than one (1) month from the date of notice.
