A Hawaii month-to-month rental agreement is a contract between a landlord and a tenant for the lease of a property without a defined end date. Both parties are subject to other provisions of state landlord-tenant law, but may choose to end the lease regardless of how much time has passed, so long as they provide sufficient notice. Like a standard lease agreement, the parties may negotiate most terms, such as responsibility for utilities.
Minimum Termination Period
When the tenancy is month-to-month, the landlord may terminate the rental agreement by notifying the tenant, in writing, at least forty-five (45) days in advance of the anticipated termination. The tenant may terminate the rental agreement by notifying the landlord, in writing, at least twenty-eight (38) days in advance of the anticipated termination.
