Delaware Month-to-Month Rental Agreement

A Delaware month-to-month rental agreement, sometimes called a “tenancy at will,” is a contract between a landlord and a tenant for the lease of a property for an undefined amount of time. Either party may terminate the agreement by providing the requisite notice and adhering to other applicable laws, regardless of how long the agreement has been in effect. Month-to-month leases provide landlords and tenants with flexibility while providing rules and a guaranteed amount of time to seek new arrangements.

Minimum Termination Period

Where the term of the rental agreement is month-to-month, the landlord or tenant may terminate the rental agreement by giving the other party a minimum of sixty (60) days’ written notice. The 60-day period shall begin on the first day of the month following the day of actual notice.
